Contracts Law: The Foundation of Legally Binding Agreements

 

Contract, which is one of the most fundamental issues of law, is one of the many legal transactions we make in our daily lives, consciously or unknowingly. In essence, the contract is established by mutual and appropriate declarations of will, that is, by agreement of more than one party. However, disputes generally arise due to the failure of one or more of the parties to comply with the terms of the contract in the future. In particular, contracts that do not pass the control of an specialized lawyer invite legal disputes.

General provisions regarding the contract are regulated in the Turkish Code of Obligations No. 6098,  and certain types of contracts are also regulated in the same law. However, it should not be overlooked that the parties have freedom of will as a rule, and that they can draw up an atypical contract that is not included in the TCO or any other law.
